Terms of Service

By creating an account on TeePopUp ("Platform", "we", "us", "our"), you ("Seller", "User") agree to be bound by these Terms of Service. If you do not agree, do not use this platform.

TeePopUp is a storefront builder that allows print shops and apparel businesses to create an online store and share it with their customers. TeePopUp is a TECHNOLOGY PLATFORM ONLY. We are not a payment processor, marketplace, fulfillment company, or printer. We do not sell products, process payments, or participate in any transaction between sellers and their customers in any way.

TeePopUp does NOT process, handle, hold, collect, or transmit any payments of any kind. All payment methods displayed on seller storefronts (including but not limited to Zelle, Cash App, Venmo, PayPal, and bank transfers) are provided solely by the seller and are entirely the seller's responsibility. TeePopUp has no involvement in any financial transaction between a seller and their customer. We make no guarantees regarding payment success, fraud protection, chargebacks, or refunds. Any payment disputes are strictly between the seller and their customer.

As a seller on TeePopUp, you agree that you are solely and fully responsible for: a) All products listed in your store b) The accuracy of your product descriptions, pricing, and images c) Fulfilling all orders placed through your storefront d) All customer service, returns, refunds, and disputes e) Collecting and remitting any applicable sales tax f) Complying with all local, state, and federal laws and regulations g) Your payment methods and any disputes arising from them h) The content you upload to your storefront

You MAY NOT list, sell, promote, or display any of the following on your TeePopUp storefront: a) INTELLECTUAL PROPERTY VIOLATIONS - Products featuring logos, names, characters, or designs owned by third parties without explicit written authorization - This includes but is not limited to: Nike, Jordan, Supreme, Disney, Marvel, DC, Star Wars, NFL, NBA, MLB, NHL, NCAA, any sports team logos, band logos, movie/TV show artwork, video game characters, or any other trademarked or copyrighted material - Fan art that incorporates protected intellectual property - Counterfeit or replica products of any kind b) ADULT/EXPLICIT CONTENT - Sexually explicit or pornographic content - Any content involving minors in any inappropriate context c) HATE SPEECH AND DISCRIMINATION - Designs promoting hate speech, racism, sexism, homophobia, or discrimination of any kind against any group - Content associated with hate groups or extremist organizations - Symbols of hatred (swastikas, white supremacist imagery, etc.) d) VIOLENCE AND ILLEGAL CONTENT - Content promoting or glorifying violence - Designs related to illegal activities or substances - Content that threatens or harasses individuals e) MISLEADING CONTENT - False advertising or misleading product descriptions - Impersonation of other businesses or brands Violation of any prohibited content policy may result in immediate account suspension or termination without refund of any subscription fees.

You represent and warrant that: a) You own or have the legal right to use and sell all designs, images, and content in your store b) Your content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property right of any third party c) You have obtained all necessary licenses, permissions, and releases for any content you upload or sell If TeePopUp receives a valid complaint or DMCA takedown notice regarding your content, we reserve the right to remove the content and/or suspend your account immediately.

TeePopUp complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, please see our DMCA Policy page to submit a takedown request. Sellers who repeatedly infringe intellectual property rights will have their accounts terminated.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: a) TeePopUp is not liable for any transactions, payments, disputes, chargebacks, or fraud occurring between sellers and their customers b) TeePopUp is not liable for any lost revenue, lost profits, or business losses of any seller c) TeePopUp is not liable for any intellectual property claims arising from seller content d) TeePopUp is not liable for any failure of third-party payment services used by sellers e) Our total liability to you for any claim shall not exceed the total subscription fees you paid to TeePopUp in the 3 months preceding the claim f) TeePopUp provides the platform "as is" without warranties of any kind, express or implied

You agree to indemnify, defend, and hold harmless TeePopUp, its owners, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from: a) Your use of the platform b) Your storefront content c) Your products or services d) Any transaction between you and your customers e) Your violation of these Terms f) Any intellectual property infringement by you g) Any dispute between you and your customers

TeePopUp reserves the right to suspend or terminate any account at any time for any reason, including but not limited to violation of these Terms. We are not required to provide a reason for termination. Terminated accounts are not entitled to a refund of subscription fees.

Subscription fees are billed monthly. All fees are non-refundable. Failure to pay will result in store deactivation. TeePopUp reserves the right to change subscription pricing with 30 days notice.

TeePopUp reserves the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
